1. General Information

Welcome to SafeBoat! These Terms of Service ("Terms") govern your access to and use of the SafeBoat mobile application ("App") and the SafeBoat website ("Website"), collectively referred to as the "Services." By downloading, installing, or using the App or accessing the Website, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. About SafeBoat

SafeBoat is an application developed to help boat owners and captains keep their boats safe by providing drift alerts, position tracking, and similar features. SafeBoat is intended only as a supportive and informational tool — it does not replace proper navigation, seamanship, or safety practices.

At present, SafeBoat is operated by an independent developer and is provided free of charge. Future updates may include company ownership or paid services, at which time these Terms may be updated.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Services. By using SafeBoat, you represent that you meet these requirements.

4. Use of the Services

• You agree to use SafeBoat only for lawful purposes and in accordance with these Terms.
• You are responsible for ensuring that your device and connection are suitable for operating the App.
• You agree not to modify, reverse-engineer, distribute, or exploit the Services or their content.

5. Important Safety Disclaimer

SafeBoat is intended solely as an auxiliary tool for assisting boat owners and captains in monitoring boat safety conditions. It does not replace proper seamanship, navigation skills, or professional safety practices.

By using SafeBoat, you acknowledge and agree that:

• You are solely responsible for your vessel's operation, safety, and decision-making at all times.
• SafeBoat's data, alerts, and recommendations may be delayed, inaccurate, incomplete, or unavailable due to factors such as signal loss, GPS errors, device malfunction, network issues, or environmental conditions.
• You must never rely exclusively on SafeBoat to prevent accidents, drifting, or any other safety risk.
• The final responsibility for your safety and your vessel's safety rests entirely with you, the captain or owner.

5.1. No Warranty

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. SafeBoat makes no guarantees that the App or Website will function without interruption, error, delay, or defect.

To the maximum extent permitted by law, SafeBoat disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.

6. Limitation of Liability

To the fullest extent permitted by law, SafeBoat and its owners, developers, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to:

• Use or inability to use the App or Website
• Inaccurate data, failed notifications, or technical issues
• Personal injury, property damage, or loss of life
• Boat damage, loss, or any other consequence resulting from reliance on the Services
• You agree that any use of SafeBoat is entirely at your own risk.

6.1. Updates and Modifications

SafeBoat may update or modify the Services or these Terms at any time. Continued use after changes are posted means you accept the revised Terms.

6.2. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

6.3. Termination

SafeBoat reserves the right to suspend or terminate access to the Services at any time, without notice, for any reason, including breach of these Terms.

7. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkiye. Any disputes shall be resolved exclusively in the courts of Izmir/Turkiye.
